Welcome to BTE Recovery. By requesting or utilizing our towing, breakdown, or vehicle recovery services, you agree to the following Terms of Service. Please read them carefully.
1. General Provisions
These terms apply to all services provided by BTE Recovery, operating out of Cork, Ireland. By engaging our services via phone, online, or in person, you enter into a binding agreement with BTE Recovery based on the terms outlined below.
2. Services Provided & Roadside Assistance Limitations
BTE Recovery provides vehicle towing, breakdown assistance, and vehicle transport.
- No Guarantee of Roadside Repair: Our primary duty is the safe recovery and transport of your vehicle. While we may attempt minor roadside fixes (such as jump-starts or wheel changes), these are done on a "best effort" basis. We do not guarantee that your vehicle can or will be repaired on the roadside.
- Secondary Towing: If a roadside repair is unsuccessful, the vehicle will need to be towed to a garage or location of your choice. Standard towing rates will apply for this transport.
- Right to Refuse Service: We reserve the right to refuse service if the environment is deemed unsafe for our operators, if the vehicle is overloaded, or if a customer is abusive.
3. Pricing, Quotes, and Payment
- Minimum Fee: A minimum total fee of €120 applies to all service call-outs and towing requests, regardless of the distance or whether the vehicle is repaired on the spot.
- Nighttime Surcharge: An additional out-of-hours surcharge of €65 applies to all jobs requested or executed between the hours of 8:00 PM and 8:00 AM.
- Right to Change Rates: BTE Recovery reserves the right to change our service rates, call-out charges, and per-kilometer towing fees at any time without prior notice.
- Estimates: Any price quoted over the phone is an estimate based on the information provided by the customer (e.g., location, vehicle condition). If our operator arrives on the scene and the situation differs (e.g., the vehicle is in a ditch, missing wheels, or further away than stated), the final price will be adjusted accordingly.
- Payment Terms: Payment is due in full immediately upon the completion of the service, prior to the vehicle being released from the recovery truck, unless a prior commercial agreement is in place.
4. Cancellation Policy
If BTE Recovery is dispatched to your location and you cancel the service while our truck is en route, or if the vehicle is gone/already started upon our arrival, a standard call-out/cancellation fee will apply to cover fuel and lost operational time.
5. Scrap Vehicle Purchasing
BTE Recovery occasionally negotiates the purchase of scrap or unwanted vehicles.
- No Obligation to Purchase: We are under absolutely no obligation to purchase any vehicle on the roadside, at your home, or otherwise.
- Negotiation Basis: Any potential purchase is based strictly on mutual negotiation and on-site inspection by our operator.
- Documentation: We will not purchase any vehicle without the provision of the official Vehicle Licensing Certificate (Logbook/VLC) matching the seller's valid photographic ID.
6. Liability and Damage Waivers
To protect both the customer and BTE Recovery, the following liability limitations apply:
- Pre-Existing Damage: BTE Recovery is not liable for any pre-existing damage to the vehicle, mechanical or cosmetic. Our operators will conduct a brief visual inspection prior to loading.
- Personal Property: Customers are solely responsible for all personal property, valuables, and cash left inside the vehicle. BTE Recovery accepts no liability for lost, stolen, or damaged items left inside a vehicle during transport or storage.
- Modified/Low Clearance Vehicles: If your vehicle has been heavily modified, lowered, or has a broken suspension, you must inform us prior to dispatch. BTE Recovery is not liable for damage to bumpers, exhausts, or undercarriages of vehicles with abnormally low ground clearance during the loading and unloading process.
- Unavoidable Delays: We are not liable for delays in arrival times caused by extreme weather conditions, road closures, or heavy traffic in the Cork and surrounding areas.
7. Customer Responsibilities
The customer must ensure they have the legal right to order the towing of the vehicle. The customer must provide accurate information regarding the vehicle's location, make, model, and the nature of the breakdown. Customers are advised to wait in a safe location (e.g., behind the safety barrier on a dual carriageway) while waiting for the recovery truck to arrive.
8. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Ireland. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the Irish courts.
